General Terms and Conditions (GTC)
My Aurelia
§ 1 Scope and Provider
(1) These General Terms and Conditions apply to all orders placed by consumers via the My Aurelia online shop.
(2) The provider and contractual partner is:
Cengizhan Oral – My Aurelia
Birkenstr. 8
95111 Rehau
Germany
E-mail: info@myaurelia.com
(3) For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
(4) Any deviating terms and conditions of the customer shall only become part of the contract if the provider expressly agrees to their validity.
§ 2 Conclusion of Contract
(1) The subject of the contract is the sale of jewelry and other goods offered in the online shop.
(2) The presentation of products in the online shop constitutes an invitation to place an order and not a binding offer by the provider.
(3) The customer may add desired products to the shopping cart and check and correct their order details before submitting the order.
(4) By clicking the appropriately labeled order button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
(5) Receipt of the order is generally confirmed to the customer automatically by e-mail. This acknowledgment of receipt does not yet constitute acceptance of the purchase offer.
(6) The contract is concluded as soon as the provider expressly accepts the purchase offer, for example by means of a separate order confirmation, or dispatches the ordered goods.
(7) If the purchase offer is not accepted, no contract is concluded. In this case, any payments already made will be refunded immediately.
(8) The order data and the legally required contract information are provided to the customer in accordance with statutory provisions.
(9) The contract language is German.
§ 3 Products and Product Descriptions
(1) The essential characteristics of the offered goods are set out in the respective product descriptions in the online shop.
(2) Product images are for illustrative purposes. Minor deviations in color representation may occur due to different screen settings. Agreed or expressly warranted characteristics remain unaffected by this.
(3) The provider resells finished jewelry pieces. Individually crafted or personalized goods are only offered if this is expressly stated for the respective product.
§ 4 Data Protection
The processing of personal data is carried out in accordance with the separate privacy policy. This is available in the online shop and is not part of these GTC.
§ 5 Right of Withdrawal for Consumers
(1) Consumers are granted a withdrawal period of 30 days for orders placed via the online shop. The period generally begins upon receipt of the goods. For multiple items in a single order that are delivered separately, as well as in other cases provided for by law, the start of the period is governed by statutory provisions.
(2) Withdrawal may be effected by an unambiguous declaration to the provider, for example by e-mail to info@myaurelia.com.
(3) To the extent required by law, an electronic withdrawal function is also available to the customer in the online shop.
(4) Details regarding the exercise of the right of withdrawal, the start of the period, the return process, return costs, and refunds can be found in the separate withdrawal policy.
(5) Statutory exceptions to the right of withdrawal remain unaffected. An exception only exists if the respective statutory requirements are met.
§ 6 Delivery and Shipping
(1) The provider delivers exclusively within Germany.
(2) The estimated delivery time is 2–4 business days, unless a different delivery time is specified for the respective product or during the ordering process. The delivery information provided before the conclusion of the order is authoritative.
(3) Shipping is free for order values of €50.00 or more. For order values under €50.00, the shipping costs specified in the online shop before the conclusion of the order apply.
(4) Should an ordered product exceptionally be unavailable, preventing the fulfillment of the order, the customer will be informed immediately. Payments already made will be refunded immediately in such cases.
(5) For consumers, the risk of accidental loss and accidental deterioration of the goods generally only passes upon delivery of the goods to the customer or a person authorized by them to receive the goods. Statutory exceptions remain unaffected.
(6) Statutory customer rights in the event of delivery delays remain unaffected.
§ 7 Payment and Retention of Title
(1) The available payment methods are displayed to the customer during the ordering process. These may include, in particular, PayPal, credit card, Klarna, Shop Pay, Apple Pay, and Google Pay.
(2) Unless otherwise specified for the chosen payment method, the purchase price is due upon conclusion of the contract.
(3) The provider applies the small business regulation according to § 19 UStG (German Value Added Tax Act). Therefore, no value added tax is charged or shown.
(4) The delivered goods remain the property of the provider until the purchase price has been paid in full.
§ 8 Warranty
(1) The statutory provisions regarding liability for defects apply.
(2) The customer is requested to check the delivered goods promptly for completeness and obvious damage and to report any complaints as soon as possible. Failure to do so does not limit the statutory warranty rights of consumers.
(3) Deviations from objectively expected product properties only become part of the contract if the statutory requirements for an effective agreement are met.
(4) The statutory rights of the customer in the event of defective goods remain unaffected.
§ 9 Applicable Law
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as this is legally permissible.
(2) In relation to consumers, this choice of law only applies to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state of their habitual residence.
§ 10 Consumer Dispute Resolution
The provider is generally neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board, unless there is a statutory obligation to do so. Statutory information obligations remain unaffected.
§ 11 Final Provisions
Statutory provisions apply. Should any provision of these GTC be or become invalid, the remaining provisions shall remain unaffected within the scope of legal requirements.
